Layperson Preamble
The platform contains content for you to browse and purchase instantly. We at ContentAvenue aim to maintain and update the platform for optimal use and availability. You may not copy, publish or use the title and summary descriptions for your own purposes. You do, however, have rights to the title and summary of an article after purchase.
Like many other websites and platform services you may not copy the design or in any way use the logos, name, or content that could infringe on our copyrights.
You must safeguard your personal details, such as your password, and ensure all information contained in your profile settings is accurate and up to date.
We have no intention of sharing any information about you, other than what is required to run and operate the platform services or services you request.
Overview
ContentAvenue distils scientific discoveries, global matters, technological advances, and current trends into simple and compelling articles and stories. After a rigorous editing process, new articles are available for purchase on the Platform.
‘Platform’ means our ContentAvenue platform, available at ContentAvenue.com
By signing up and registering for a membership account on the ContentAvenue website or platform you agree accept the terms and services outlined in the membership agreement.
Platform Services
The Platform’s services are offered subject to acceptance of all the terms and conditions contained in these Terms including the Privacy Policy and Terms of Service available, and all other operating rules, policies, and procedures that may be published on the Website by the Platform or which are otherwise applicable in relation to the Services, which are incorporated by reference.
These Terms apply to every user (registered or unregistered) who has purchased Content from the Platform. In addition, some services offered through the Services may be subject to additional terms (as specified by the Platform). Your use of those services is subject to those additional terms and conditions, which are incorporated into these Terms by this reference.
Keep Yourself Updated
The Platform reserves the right, at its sole discretion, to modify or replace these Terms by posting the updated terms on the Website. It is your responsibility to check the Terms periodically for changes. Your continued use of the Services following the posting of any changes to the Terms and Conditions constitutes acceptance of those changes.
These Conditions are applicable to all Purchase Contracts, Services, and Offers made by the Platform.
The Platform reserves the right to make alterations and/or additions to the Terms and Conditions at any time. The altered Terms will be made known to User and will be applicable from that moment on.
If User consists of several legal entities or organisations, each will be responsible for the entire fulfilment of the Contract.
Additional Rules and Regulations may Apply alongside these Terms.
As a condition of use, the User shall not use the Services for any purpose that is prohibited by the Terms or law. The User is responsible for all its activity in connection with the Services. The User shall not permit any third party to use their account.
Registration
In order to register to use the Platform you must either (i) be at least 18 years of age or (i) have obtained consent from the parent or legal guardian. By registering to use the Platform, you represent and warrant that this is the case.
You agree that you will provide truthful and accurate information when registering to use the Platform. The decision to accept a registration is in our discretion and we may revoke a registration at any time.
You may not register to use the Platform if the User is already registered or if you were previously a registered user and we cancelled your account as a result of you being in breach of these Terms.
The User is responsible for maintaining the confidentiality of your password, account information and any external review links generated by you, and the User is solely responsible for all activities that occur under your password, account or an external review link generated by you, and for any access to or use of the Platform by you or any person or entity using your password or an external review link generated by you, whether or not such access or use has been authorised by you.
You must immediately notify us of any unauthorised use of your password or account, an external review link generated by you, or any other breach of security. We will not be liable for any loss or damage whatsoever resulting from the disclosure of your username and/or password contrary to these Terms.
The User is responsible for ensuring that the information we hold about you is up to date. Please amend your details via the Platform as appropriate from time to time or contact us if you require assistance.
Without limitation, you may not use the Platform:
in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
in any way to deliberately damage and/or harm groups or minorities;
to send, or procure the sending of, any unsolicited or unauthorised electronic communication, advertising or promotional material or any other form of similar solicitation (spam); or
You also agree not to:
reproduce, duplicate, copy or re-sell any part of the Platform (or any content within it) in contravention of these Terms; and
access without authority, interfere with, damage or disrupt: (A) any part of the Platform; (B) any equipment or network on which the Platform is stored; (C) any software used in the provision of the Platform; or (D) any equipment or network or software owned or used by any third party.
Age and Responsibility
You declare that you are of sufficient legal age to use the Platform and to create binding legal obligations for any liability you may incur as a result of the Platform. You agree to be responsible for all your use of the Platform (as well as for use of your Member Name and password(s) by others, including without limitation, minors living with you). You agree to supervise all usage by minors of the Platform under your name or account.
Privacy
You agree that any and all personal information you provide to us via this website or registration may be collected, stored, processed and used in accordance with our current Privacy Policy.
Withdraw Membership
You may terminate this Membership Agreement at any time. We will require that you be able to properly identify your account details. You can contact us here.
Force Majeure Event
The Platform is not obliged to fulfil the Contract if prevented from doing so as a result of circumstances beyond its control. The Platform can also appeal to force majeure if a Force Majeure Event occurs after the Platform should have met its obligations.
If the deficiencies as a result of a Force Majeure Event are of a temporary nature, the Platform may suspend its obligations until the Force Majeure Event ceases to exist, without being obliged to any form of damage compensation. The Platform reserves the right in the event of force majeure to claim payment from User for work already carried out by the Platform.
The deficiencies as a result of force majeure give User the right to dissolve the Contract and withdraw from using the Platform’s service.
Assignment
We may at any time assign, mortgage, charge, subcontract, sublicense or otherwise transfer any or all of our rights and obligations under these Terms.
You may not assign, mortgage, charge, subcontract, sublicense or otherwise transfer any of your rights or obligations under these Terms without our prior written consent.
Applicable Law and Jurisdiction
All Contracts made between the Platform and User are governed by the laws of Denmark.
Disputes shall, at the choice of the Platform, be settled by the courts of Denmark.
Miscellaneous
If any provision or part of a provision of these Terms is held to be illegal, invalid, unenforceable or against public policy pursuant to a final adjudication by a court of competent jurisdiction, such provision will be deemed severed from these Terms and the remainder of these Terms will remain in full force and effect.
These Terms, and the documents referred to in them, constitute the entire agreement between you and us in relation to the subject matter of these Terms and supersede and extinguish any prior agreement in respect of the same.
Nothing in these Terms shall limit our right to bring a suit, action or proceeding (Proceeding) against you in the courts of any country in which you have assets or in any other court of competent jurisdiction nor shall Proceedings we institute in any one or more jurisdictions preclude us from instituting Proceedings in any other jurisdiction (whether concurrently or not) if and to the extent permitted by applicable law.
